Terms of Use

1. Using this site

You may browse and share this site for personal and business purposes. You agree not to misuse it, including attempting to disrupt it, access it without authorization, send spam or malicious content through our forms, or scrape or copy content for commercial use.

2. Our work and intellectual property

The design, text, graphics, and code of this site, and the Heavybrea name and logo, belong to Heavybrea Multimedia. Portfolio pieces are shown to demonstrate our work. Client names, logos, and trademarks shown (for example, Best Buy, Kingspan, and Keller Williams) belong to their respective owners and are displayed for portfolio purposes only; their appearance does not imply endorsement. You may not reuse our portfolio work or site content without written permission.

3. Information on this site

We work to keep the information on this site accurate and current, but it is provided “as is” for general information. Descriptions of services, results, and timelines are examples, not guarantees. Project scope, pricing, deliverables, and timelines are set only in a written proposal or agreement between you and Heavybrea.

4. Consultations and bookings

Free Discovery Call (15 minutes): an informal, no-obligation conversation.

Design Strategy Session (60 minutes): a paid consultation, currently $200, paid in advance when booking. If you hire Heavybrea for a project within 30 days of your session, the full session fee is credited toward that project. Please reschedule or cancel at least 24 hours before your session using the links in your booking confirmation; sessions cancelled with less notice, or missed, may not be refundable. Recommendations shared during a session are general guidance based on the information you provide.

5. Contact form and communications

When you contact us, you confirm that the information you provide is accurate and that you have the right to share any files or materials you send. Sending an inquiry does not create a client relationship or obligate either party. Please don’t send confidential information through the contact form; we’ll arrange a secure way to share it if needed. See our Privacy Policy for how we handle your information.

6. Unsolicited ideas and submissions

We welcome project inquiries, but please don’t send us unsolicited creative ideas, concepts, or designs unless we’ve agreed in writing to review them. Heavybrea develops a wide range of original work, and something you send may be similar to work we have already created or are developing independently. If you do send unsolicited ideas or materials, you agree that they are not confidential, that we have no obligation to review, use, or compensate you for them, and that we remain free to create and use similar work without obligation to you.

7. Third-party links and services

This site links to and uses services we don’t control, including Behance, TidyCal, PayPal, social media platforms, and derekrobinson.tech. We aren’t responsible for their content, policies, or availability.

8. Disclaimer and limitation of liability

This site is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, Heavybrea Multimedia and Paraggello LLC are not liable for any indirect, incidental, or consequential damages arising from your use of this site. Our total liability relating to the site will not exceed $100. Work performed for clients is governed by the separate agreement for that project.

9. Copyright concerns

We respect the intellectual property of others. If you believe something on this site infringes your copyright or other rights, email info@heavybrea.net with a description of the work, where it appears on our site, your contact information, and a statement that you believe in good faith the use is not authorized. We will review the request promptly and remove or correct material where appropriate.

10. Governing law

These terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Any disputes will be handled in the state or federal courts located in Fulton County, Georgia.

11. Changes

We may update these terms from time to time. The effective date above shows when they were last changed. Continued use of the site means you accept the updated terms.

12. General

If any part of these terms is found to be unenforceable, the remaining parts stay in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. These terms, together with our Privacy Policy, are the entire agreement between you and us about your use of this site; any project work is governed by its own written agreement.
